IPSA Kind Of Magic: The Scottish System - Better or Just Different?
There are certain conversations within the property industry that seem to return every few years. One of them is whether England and Wales could learn something from the Scottish conveyancing system.
At first glance, many people simply see Scotland as “faster.” Transactions often move more quickly, fall-through rates are generally lower, and buyers and sellers appear to reach legal certainty earlier in the process.
Yet once you look a little deeper, it becomes clear the discussion is far more interesting than simply deciding which system is “better.”
This week on IPSA Kind Of Magic, Gareth Wax will once again be joined by Hamish McLay and Jackie Dyson for a relaxed conversation looking at some of the key differences between the systems and whether any lessons could realistically be applied further south.
One of the biggest distinctions is the timing of legal commitment.
In Scotland, the exchange of missives between solicitors creates a binding agreement much earlier in the process than most people in England and Wales are used to. That earlier certainty can reduce the risk of transactions collapsing late in the day and may also help limit practices such as gazumping or gazundering.
For many buyers and sellers in England and Wales, the current process can sometimes feel rather uncertain by comparison.
People may spend months progressing surveys, searches, mortgage applications and legal work, only for a transaction to fall apart close to exchange. The emotional and financial impact of that can be significant, particularly for buyers already stretching themselves financially.
The conversation also ties into the growing discussion around upfront information.
In Scotland, sellers are generally expected to provide far more information before a property even reaches the market. Home Reports, surveys and property questionnaires all help buyers understand more about the property at an earlier stage.
That naturally raises an interesting point for the IPSA community because the discussion around “Important Information” and front-loading transactions has been steadily growing across England and Wales for several years now.
The industry increasingly recognises that buyers, conveyancers and lenders benefit from having clearer information available earlier in the process.
At the same time, it would probably be unrealistic to assume England and Wales could simply copy the Scottish model overnight.
The legal structures are different. The culture around property transactions is different. Chains often operate differently. Even the expectations placed upon buyers and solicitors vary considerably.
That is why this becomes a far more balanced discussion than simply saying one system works and another does not.
It may be less about replacing the current process and more about asking whether certain ideas could improve parts of it.
For IPSA members and search agents, there is another important angle sitting quietly underneath the wider debate.
If the industry moves toward earlier commitment and earlier disclosure, then the role of properly refined information becomes even more important.
Searches are no longer simply about obtaining data. Increasingly, they involve interpreting information, identifying risks and helping conveyancers navigate growing volumes of material and digital records.
Technology may allow more information to be gathered quickly, although understanding what truly matters within that information still relies heavily upon experience, judgement and local knowledge.
It will be interesting to hear where this week’s conversation leads because there are reasonable arguments on all sides.
What seems increasingly clear, however, is that the discussion around upfront information, transaction delays and consumer confidence is not going away anytime soon.
