WiggyWam Launchpad - Terms and Conditions

Effective Date: May 2025


Welcome to Launchpad by WiggyWam ("Platform"). These Terms and Conditions ("Terms") govern your use of Launchpad by WiggyWam, provided by WiggyWam Limited ("WiggyWam", "we", "us", "our"). By creating or supporting a campaign on Launchpad, you agree to be bound by these Terms.


1. Definitions
•    Campaign Creator: An individual or organisation who launches a fundraising campaign using Launchpad.
•    Backer or Supporter: A person or organisation who contributes funds to a campaign.
•    Reward: A non-financial benefit (e.g., promotional acknowledgement, merchandise, discounted services) offered by Campaign Creators to Backers or Supporters.
•    Platform: Launchpad’s fundraising service is hosted at wiggywam.co.uk/launchpad or associated subdomains.
•    User: Any individual accessing or using the Platform, including Campaign Creators and Supporters.


2. Purpose of Launchpad
Launchpad enables property-related individuals, businesses, and communities to raise funds for innovative, creative, or commercial projects. The Platform supports community-based donations and reward-based crowdfunding only. It does not facilitate investment, equity crowdfunding, financial returns, or securities offerings.


3. No FCA Authorisation – Important Disclaimer
It is important to note that Launchpad is not authorised or regulated by the Financial Conduct Authority (FCA). Accordingly, the platform does not support, nor allow financial promotions, share offerings, loans, or investment returns in any form. All contributions are voluntary, made at the Supporter's own risk, with no guarantee of financial return or campaign success.


4. Platform Role and Limitations
Launchpad acts solely as an intermediary, providing tools for Campaign Creators to raise funds and for Supporters to contribute. We do not guarantee project success, fulfilment of rewards, or appropriate use of funds. We conduct light reviews of campaigns for general compliance purposes but we do not independently verify project claims.


5. Campaign Creator Responsibilities
Campaign Creators must:
•    Provide accurate, honest, and clear descriptions of their project and any Rewards.
•    Deliver promised Rewards within a reasonable timeframe.
•    Offer only non-financial rewards (e.g., acknowledgements, services, products, advertising on their own websites etc.).
•    Not offer or imply to offer shares, investment returns, debt repayments, or financial incentives of any kind.
•    Ensure promised advertising space or promotions appear only on their own projects (i.e. not on the WiggyWam platform).
•    Campaign Creators must complete mandatory identity verification through either Stripe or PayPal prior to campaign launch. If this is not setup prior to campaign launch, you will not be eligible to accept donations.


6. Supporter Responsibilities
Supporters acknowledge that by using Launchpad and making contributions to campaigns, they do so on a voluntary basis, understanding they are not purchasing goods or investments, but are supporting initiatives they believe in. Any Reward offered in exchange is solely the responsibility of the Campaign Creator and not WiggyWam Limited, nor Launchpad. Supporters are encouraged to perform their own due diligence before contributing, particularly if they are considering making a large contribution.


7. Account Registration
All Users must register for an account on the WiggyWam platform prior to launching or backing a campaign. Users are individually responsible for safeguarding their login credentials and all activity under their accounts. We shall not be held liable for any circumstances arising from a failure to do so.


8. Verification and Payment Processing
We use trusted third-party providers, such as Stripe and PayPal, for payment processing.
•    Campaign Creators must follow the onboarding process of their preferred payment processor such as passing their KYC (Know Your Customer) checks and linking a valid payment account.
•    Funds raised are processed securely via Stripe or PayPal in accordance with their terms and conditions.
•    WiggyWam Limited and Launchpad does not hold or control funds directly. 
Payment processor verification procedures help maintain trust but do not offer any guarantees regarding the success of project outcomes.


9. Platform Fees
WiggyWam charges a platform fee on successful campaigns. Processing fees by Stripe or PayPal also apply. Any fee rates applicable are transparently displayed before campaign launch.


10. Refunds and Cancellations
All contributions are non-refundable, unless otherwise required by applicable UK consumer protection laws. Disputes regarding Reward fulfilment must be addressed directly between the Campaign Creator and the Supporter and not WiggyWam and/or Launchpad. By continuing to use Launchpad and make a contribution towards a campaign, contributors acknowledge they are doing so of their own free will and shall not be entitled to a refund.


11. Acceptable Use
By using WiggyWam and/or Launchpad, you agree not to:
•    Misuse the Platform for illegal, harmful, or fraudulent purposes.
•    Make any misrepresentations regarding your project, personal or business identity, or intentions.
•    Engage in scams, pyramid schemes, hate speech, or discrimination.
•    Promote investment products, shares, loans, or regulated financial promotions.
We reserve the right to immediately suspend or remove campaigns or accounts that violate these rules. Any decision made or subsequent action taken by WiggyWam in this regard shall be the final say in the matter.


12. Intellectual Property
All WiggyWam branding, content, and design elements remain the intellectual property of WiggyWam Limited. Users may not copy, modify, claim ownership of, distribute, or use WiggyWam’s intellectual property without our express written permission. Further, all Campaign Creators, Sponsors, Backers or Users acknowledge they are expressly forbidden from making claims or representations that they work with, or for, WiggyWam in any form. Campaign Creators retain ownership of their original project content but by continuing to use Launchpad, they grant WiggyWam an exclusive licence to display and promote it on the Platform.


13. Privacy and Data Protection
Your use of Launchpad is subject to our Privacy Policy which explains how we collect, process, and protect your personal data in accordance with the UK GDPR and Data Protection Act 2018.


14. Disputes and Complaints
If you believe a campaign is fraudulent, misrepresented, or otherwise in breach of these Terms, you should report it immediately via email to: support@wiggywam.co.uk – ideally using the subject line heading: “Potential Campaign Misrepresentation.” We will then investigate and take the appropriate action, which may include campaign suspension. Where Campaign Creators are found to be in breach of these Terms, they will be banned from using the WiggyWam Platform indefinitely.


15. Limitations of Liability
WiggyWam provides the Platform "as is". We make no warranties or guarantees regarding campaign success, platform uptime, or accuracy of information presented. We shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of Launchpad. Supporters participate entirely at their own risk.


16. Changes to These Terms
WiggyWam may amend these Terms at any time. Continued use of the Platform following updates constitutes acceptance of any new or revised Terms. Our updated Terms will be provided on the Launchpad section of the WiggyWam Platform.


17. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales only.

19. Payments & Refunds

Payments made by Supporters are processed directly through Stripe or PayPal before being transferred to Campaign Creators. WiggyWam Limited does not, at any point, hold, manage or process funds.
Any requests for refunds, cancellations, or disputes relating to a contribution must be made directly between the Supporter, the Campaign Creator, and the relevant payment processor (Stripe or PayPal) according to their respective policies.


WiggyWam is not responsible for enforcing refund obligations or mediating financial disputes between Users.
